6. Cancellations, Returns, Replacements and Refunds Policy
We want you to be genuinely happy with every Communal order. This section summarises our policy; the most current version is also published on our Refund & Cancellation Policy page, which forms part of this T&C.
Order Cancellation: You may request cancellation of an order before it has been shipped by contacting us at the details below. Once an order has been dispatched, it cannot be cancelled; you may instead rely on our return/replacement process below, where applicable.
Returns (Unopened Products): We accept returns of full-priced, unopened and unused Products, provided the return is initiated within 7 (seven) days of delivery. Once the returned Product reaches our warehouse and passes verification, we will process your refund and notify you by SMS and email, subject to the non-refundable cases below. Reverse pickup is available for most locations in India — please contact our customer care team to arrange this.
Non-Refundable Cases:
- Opened, used, or sale/discounted Products are not eligible for return, replacement or refund.
- For Partial-COD (PCOD) orders returned to origin (RTO), the partial COD amount collected at the time of booking is non-refundable.
- For prepaid orders that are returned by the customer, or that come back as RTO, where the Product is not damaged, expired or defective, the amount paid is non-refundable.
- We are not responsible for any damage to a Product occurring after delivery.
If you receive a package that has already been opened or appears tampered with, please refuse the delivery immediately and inform our customer care team.
Replacement (Damaged, Expired, Defective or Missing Products): If you receive the wrong Product, an expired Product, a damaged or defective Product, or your order arrives with an item missing, you may raise a replacement request. Such cases are eligible for replacement only (not return or refund), subject to stock availability and verification by our team.
Video Proof Required: For any claim involving a missing, damaged, defective or expired Product, you must submit a clear unboxing video showing the sealed package being opened and the issue in question. Requests submitted without valid video proof will not be eligible for replacement.
How to Raise a Request: Contact us within 7 days of delivery at customercare@communal.care or +91 91756 66254, along with the required video proof. Please allow us 2 working days to review and approve your request. Once we receive the returned Product (where applicable) and verify your proof, we will process a replacement, subject to stock availability.
Perishable/Certain Categories: Cancellation or return requests may not be entertained once an order has been communicated to our vendors/warehouse partners and shipping has commenced, or for categories that are inherently non-returnable due to hygiene or safety reasons, except where the Product is established to be defective, damaged, expired or not as described, subject to the video-proof requirement above.
Product Not as Described: If a Product received differs materially from what was shown on the Website, please notify our customer care team within 7 days of delivery. Our team will review your complaint and take an appropriate decision.
Manufacturer Warranty: Where a Product carries a warranty from its manufacturer, any related complaint should be directed to the manufacturer in accordance with the terms of that warranty.
7. Shipping and Delivery
We aim to process and ship orders promptly from our fulfilment centres across India, with a typical delivery timeline of 3–4 working days, depending on your location, product availability and courier serviceability. If your order arrives damaged, defective, incomplete, or you received the wrong item, please report it within 7 days of delivery along with an unboxing video, as set out in Section 6 above.
8. Mode of Payment
Payment for Products on the Website may be made via credit card, debit card, net banking, UPI, digital wallets, or Cash on Delivery (COD)/Partial Cash on Delivery (PCOD), where offered. Prepaid payment options are recommended for faster order processing.
9. Disclaimer of Warranties
Your use of the Website and Products is at your own risk. The Website and Products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Without limiting the foregoing, we do not warrant that: information on the Website is accurate, complete or current; links to third-party websites lead to accurate or reliable content; any oral or written advice obtained through the Website creates a warranty not expressly stated in this T&C; or that results from using any Product will meet your expectations, as results can vary from person to person.
We may change, suspend, or discontinue any aspect of the Website at any time without liability.
Health & Usage Disclaimer: Our Products are cosmetic/personal-care products and are not intended to diagnose, treat, cure or prevent any disease. If you are pregnant, nursing, taking medication, or have a history of skin conditions or allergies, please consult a physician or dermatologist before use. We recommend a patch test before first use of any Product. Discontinue use immediately if irritation, redness or an allergic reaction occurs, and seek medical advice if needed. We are not responsible for adverse reactions arising from incorrect use, use in combination with other products, or use contrary to the instructions provided.
10. Limitation of Liability
To the fullest extent permitted by applicable law, neither we nor our affiliates, partners, directors, employees or licensors will be liable whether in contract, tort (including negligence) or otherwise for: (a) business interruption; (b) delays or interruptions in accessing the Website; (c) loss, theft, corruption or unauthorised access to data; (d) losses arising from third-party links on the Website; (e) viruses or system failures connected with your use of the Website; (f) inaccuracies or omissions in content; or (g) events beyond our reasonable control.
To the fullest extent permitted by law, we will not be liable for indirect, special, incidental, punitive or consequential damages of any kind (including lost profits), even if advised of the possibility of such damages. Our aggregate liability to you for any claim arising out of or relating to your use of the Website or this T&C shall not exceed the amount paid by you for the Product(s) giving rise to the claim.
No claim or action arising out of your use of the Website or this T&C may be brought more than one (1) year after the cause of action arose.
11. Termination
This T&C remains effective until terminated by either you or us. We may, at our sole discretion and without penalty or notice, suspend or terminate your Account or access to the Website, including where you have not complied with this T&C or our policies. Termination does not affect your obligation to pay for Products already ordered, nor any liability that may have accrued prior to termination.
12. Indemnity
You agree to defend, indemnify and hold harmless the Company, its directors, officers, employees, affiliates and licensors from and against any claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys' fees) arising out of or connected with your breach of this T&C, your violation of any applicable law, or your infringement of any third-party right, including intellectual property or privacy rights. This clause survives termination of this T&C.
13. Governing Law and Jurisdiction
This T&C and our Policies shall be governed by and construed in accordance with the laws of the State of Maharashtra and the laws of India. Subject to the arbitration clause below, the courts of Maharashtra shall have exclusive jurisdiction over any disputes arising from this T&C.
Any dispute arising out of or relating to this T&C shall be referred to arbitration before a sole arbitrator mutually appointed by the parties, in accordance with the Arbitration and Conciliation Act, 1996, as amended. The seat and venue of arbitration shall be within the State of Maharashtra. Notwithstanding the above, the Company retains the right to seek injunctive or interim relief from a court of competent jurisdiction in Maharashtra to protect its intellectual property or confidential information pending arbitration.
14. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under this T&C due to causes beyond our reasonable control, including natural disasters, acts of God, war, terrorism, labour disputes, epidemic or pandemic, cyberattacks, utility or communication failures, or any governmental order having the force of law. Our obligations shall be suspended for the duration of such event.
15. General
Nothing in this T&C creates any agency, partnership or joint venture between you and the Company. Our failure to enforce any provision of this T&C shall not be construed as a waiver of that provision. Headings are for convenience only and do not affect interpretation. If any provision of this T&C is held invalid or unenforceable, that provision will be replaced by a valid provision that most closely reflects its original intent, and the remainder of the T&C will continue in effect.
Cessation of Operations: The Company may, at its sole discretion and without advance notice, cease operation of the Website and distribution of Products.
Entire Agreement: This T&C constitutes the entire agreement between you and the Company regarding your use of the Website and supersedes any prior agreements on the subject.
